Terms and conditions

ClearaScan Terms of Service

These Terms of Service ("Terms") are an agreement between you and The Pontaro Company, LLC ("we", "us", "our"), which operates ClearaScan. They cover your use of:

  • the website at clearascan.com
  • the web app at app.clearascan.com
  • the ClearaScan mobile apps for iOS and Android

By creating an account or using ClearaScan, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the app.

A plain-English summary of the key points sits under each heading. These Terms are written to be clear rather than legalistic, but they are still a binding agreement.

1. What ClearaScan does

ClearaScan helps you check food and product labels for ingredients you want to avoid. You point your phone camera at the ingredients list on the packaging, ClearaScan reads that list, and it compares what it reads against the personal avoid list (your "Ingredient Guard") that you have built for yourself or for someone you look after.

In short: we scan labels, read the ingredients, and flag the ones on your list. The reading is done by an artificial intelligence (AI) model. ClearaScan does not decide what is safe for you and does not give a health verdict beyond matching your own list against what it reads on the label.

ClearaScan is not a medical device, is not a medical service, and does not provide medical advice.

2. Who can hold an account

You must be 18 or over to create your own ClearaScan account. We capture your date of birth at signup and store the fact that you confirmed you are 18 or over. We do not knowingly create an account for anyone under 18 in their own name.

Children under 18 are supported as a Care Profile under an adult's account, not as account holders in their own right. A parent or carer sets up and is responsible for that Care Profile (see Section 9). You are responsible for keeping your account details accurate and for safeguarding your login credentials.

3. Your Ingredient Guard is entirely your own

ClearaScan does not tell you what you should or should not avoid. Your Ingredient Guard is a list you build yourself. You add every ingredient on it, you edit it whenever you want, you delete anything from it whenever you want, and you decide who each Guard is for (yourself or someone on your Care Circle). Nothing on your Guard is recommended or medically endorsed by us. You are the sole author of your own Guard, and of any Guard on a Care Profile you manage.

The quick-typing feature suggests known allergen names and their hidden synonyms while you type, but every entry only lands on your Guard because you chose to add it. Condition presets (such as Coeliac, IBS or Lactose intolerance) offer starter trigger lists curated from named UK health sources, but every trigger stays unticked by default; you actively tick each one you want.

Because the Guard is entirely user-driven, ClearaScan takes no responsibility for what you choose to include or exclude. If an ingredient that is dangerous to you is not on your Guard, it will not be flagged. Building an accurate, complete Guard is your responsibility.

4. AI label reading and translation

ClearaScan reads printed ingredient labels using an AI model (currently Anthropic Claude). If the label is not in English, the AI translates the ingredient list into English before matching. AI reading and AI translation can make mistakes: a character can be misread, an ingredient the camera could not see clearly can be missed, or a translation can be imperfect.

When the model is not confident it has read the whole label, we deliberately refuse to give a "no matches" result and mark the scan as unclear instead, prompting you to add another photo. A thin or curved package may need two or three photos to capture the full list. Even so, always verify by reading the actual printed label.

The scan sends the label photo to the AI provider only to extract the text. The photo is used only for that extraction and is not retained by us or by the provider beyond the request. No account identifier is sent with the extraction request.

5. Focus lanes and condition presets

On top of your Guard, each Care Profile can carry one or more optional "focus lanes" that flag additional ingredient classes. At launch we support ADHD-friendly (flags artificial colours, aspartame, some preservatives) and Clean eating (flags emulsifiers, artificial preservatives, ultra-processed markers). More lanes may be added as users request them.

When you set up a profile we offer optional starter lists for common conditions (Coeliac, Colitis, IBS, Lactose intolerance, Fructose malabsorption, Low-FODMAP, Migraine triggers, Gout). Each preset is curated from a named UK source such as Coeliac UK, the NHS, Crohn's and Colitis UK, Monash University, The Migraine Trust or the UK Gout Society. Everyone's triggers are different, so always confirm your specific triggers with your GP or dietitian.

6. Trusted Products, Reaction Journal and Emergency Card

A product can only be saved to a person's Trusted Products list if it came back clear for them, never on an avoid result or a not-fully-verified one. A Trusted Product saves the exact ingredient snapshot of the scan you approved. If a later scan of the same product returns a different ingredient list, we flag it as reformulated and it is no longer treated as trusted. Manufacturers change recipes without notice, so a Trusted Product is only trusted at the exact version you last confirmed. Scans older than four months cannot be reused for a new person; a fresh scan is asked for, with a gentle heads-up from three months.

The Reaction Journal is a personal record you keep, scoped to the Care Profile it was logged for. Entries can optionally be linked to a scan and shared with authorised Care Circle users, but never with third parties.

The Emergency Allergy Card is generated from a Care Profile's Guard for quick sharing with carers, restaurants or emergency staff. It is not a medical record and not a substitute for medical identification. Keep it up to date yourself.

7. Suggestions to explore

After a scan flags a match, we may show a few alternative product suggestions drawn from open third-party databases (Open Food Facts, Open Beauty Facts). These are not safety verdicts, not endorsements, and we do not verify them ourselves. Product recipes change and a database entry can lag reality, so every suggestion asks you to scan the ingredient label to be sure before consuming or applying anything.

8. Allergy and safety disclaimer

ClearaScan is not a medical device and does not provide medical advice. It does not replace reading the label yourself, and it does not detect cross-contamination or "may contain" trace risks beyond what is printed.

Results depend on three things you should keep in mind:

  • the avoid list you built (if it is incomplete, matches can be missed);
  • what the AI is able to read from the photo of the label; and
  • the printed information actually being on the packaging.

We do not guarantee accuracy, completeness or any safety outcome. You must verify product labels, use your own judgement, and consult a healthcare professional for medical decisions. If in doubt, do not consume.

In a suspected severe allergic reaction (breathing difficulty, throat tightness, swelling, dizziness or loss of consciousness): use an adrenaline auto-injector if one is prescribed, then call your local emergency number immediately. UK: 999 · USA and Canada: 911 · EU: 112. Do not delay emergency care to consult ClearaScan.

9. Care Circle and sharing

Your account can hold multiple Care Profiles, for yourself and for anyone you look after (a child, an elderly parent, a partner). Each profile has its own Guard, condition presets, focus lanes and scan history. You are responsible for the accuracy of every Care Profile on your account.

You may share a Care Profile by email invite with another adult who has their own ClearaScan account (a "Shared User"). Once they accept, a Shared User can view the profile's Guard, run scans on the profile's behalf, view its scan history and view reactions logged on it, and can log new reactions. They can edit or delete only the reactions they themselves logged.

Only the profile owner can ever add, remove or edit the allergen list, condition presets or focus lanes, and only the owner can manage Trusted Products. This is enforced at the database level through Row Level Security and cannot be bypassed by any client, admin request or API call. It exists because a Shared User quietly removing an allergen could cause someone to eat something dangerous.

You can stop sharing at any time from the Care Circle screen; access is revoked instantly. Reactions a Shared User logged stay with the profile's history, as they belong to the person, not to the Shared User.

10. Shared learning directory

When you add an ingredient to your Guard that is not already in our quick-typing library, the ingredient name and any hidden-name variations you add are submitted, anonymously, to a shared community directory. Your name, email, profile and account are not attached. An admin reviews each submission before it can appear as a suggestion to other users; rejected submissions stay on your Guard only and are never surfaced to anyone else.

This is how the app's coverage improves over time: real usage teaches the shared library. If you would rather your additions did not contribute, contact support and we will exclude your account from the learning contribution.

11. Subscriptions, trials, renewals and refunds

ClearaScan offers a 7-day free trial. The trial does not require a payment method and does not automatically convert into a paid subscription. To continue after it ends, you actively choose a paid plan.

Paid plans (Monthly and Annual) are managed through the Apple App Store on iOS or Google Play on Android. Payment is handled by Apple or Google; we do not process or store payment cards. Subscriptions auto-renew for the same period at the same price unless cancelled at least 24 hours before the end of the current period. You can cancel any time from your Apple or Google account subscription settings, effective at the end of the current billing period. Refunds are handled by Apple or Google under their standard policies; we do not directly issue refunds.

Without an active subscription (and not on trial), scanning is not available. Your saved data (Guard, Care Profiles, scan history, journal) is retained, but scanning is gated behind an active subscription.

12. Acceptable use

You must not:

  • attempt unauthorised access to the service or to other people's data;
  • reverse engineer, scrape or otherwise misuse the systems;
  • misuse the scanning functionality or automate abuse of it; or
  • upload harmful, unlawful or infringing content.

13. Data controller, hosting and transfers

The data controller for ClearaScan is The Pontaro Company, LLC. Data enquiries: contact@clearascan.com.

Your data is stored with Supabase (database and object storage). Emails are sent via Brevo. AI label reading is provided by Anthropic. Website and app hosting is on Vercel. Analytics events are sent to Google Analytics 4. Each processor has its own privacy policy and terms; using ClearaScan means your data may be transferred to and processed by these services. Where personal data is transferred outside the UK or EEA, we rely on the processor's approved transfer mechanisms (Standard Contractual Clauses or equivalent).

14. Your data rights

Under UK GDPR you have the right to access, rectify, erase, restrict processing of, and receive a copy of your personal data.

You can export or delete your entire account yourself from Settings. Both actions are available in the app and in the desktop version at app.clearascan.com; scroll to the bottom of the Settings page to find them. Deleting your account removes your profile, allergens, scans, reactions, trusted products, care profiles and support tickets from our systems within 30 days. Anonymised, aggregate analytics data may remain.

To exercise any right outside the in-app flow, contact contact@clearascan.com; we respond within one month. You also have the right to complain to the Information Commissioner's Office (ico.org.uk).

15. Cookies and analytics

We use functional cookies (session, authentication, preferences) and analytics events sent to Google Analytics 4. We do not use advertising cookies. You can control cookies via your browser settings; disabling functional cookies may break sign-in and other essential features.

Website signups may be tagged with the traffic source that brought you (referrer, landing page and, when marketing campaigns are running, campaign parameters) so we can understand how people find ClearaScan. This does not identify you personally and is used in aggregate.

16. Children's data

Account holders must be 18 or over. Under-18s can be added as Care Profiles under a parent or carer's account, and that adult is responsible for the Care Profile's Guard, sharing settings and use of the app on the child's behalf. For a Care Profile for a child under 13 (in line with the ICO Children's Code) we collect only what is necessary to run it (name or nickname, age band, allergen list, focus lanes, scans, reactions), we do not use the child's data for profiling or targeted advertising, we do not sell or share it beyond the processors named in Section 13, and all sharing settings default to off. The parent or carer can delete a Care Profile at any time, removing all of its data within 30 days.

17. Intellectual property

All software, systems, algorithms, content and branding in ClearaScan are owned by ClearaScan and The Pontaro Company, LLC. You are granted a personal, non-transferable licence to use the app for its intended purpose; nothing in these Terms transfers any ownership to you.

18. Support communications

The in-app Support surface lets you send bug reports, suggestions or general messages, and optionally attach the scan you were looking at. When you attach a scan, the photo, product name and focus context are sent to us; the name of the person the scan was for is stripped and replaced with an age band plus a focus-lanes summary before we see it. Attached scans are deleted when the ticket closes or when you delete your account, whichever is first.

We aim to reply within 48 hours on working days but do not guarantee a response time. We are not obliged to respond to messages that are abusive, threatening, discriminatory or spam, and may close such tickets without reply. Repeated abuse may result in account suspension.

19. Availability, beta features and changes to the service

Service availability may change and is not guaranteed. Some features may be labelled "beta" or released to a subset of users while we test them; beta features are provided without warranty and may be removed or altered at any time. Interruptions (planned maintenance, third-party outages, or factors beyond our reasonable control) may occur, and features may evolve over time. We make no service-level guarantee.

20. Suspension and termination

We may suspend or terminate your account for material breach of these Terms, misuse of the service (including automated abuse, credential sharing beyond your household, or attempted access to other accounts' data), fraudulent payment, or use that could harm others. Where practical we give notice; where the breach risks other users or the service, action may be immediate. Suspension or termination for cause does not entitle you to a refund of an active subscription period, without prejudice to your statutory rights. You can close your account at any time from Settings.

21. Limitation of liability

To the maximum extent permitted by law, ClearaScan and The Pontaro Company, LLC are not liable for:

  • health outcomes or allergic reactions;
  • reliance on scan results;
  • indirect or consequential loss; or
  • business interruption.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under law, including liability for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.

22. App Store and Google Play terms

Where you obtain the app via the Apple App Store or Google Play, Apple's or Google's own end user licence agreement also applies to your use of the app on their platform. Where these Terms conflict with a platform's mandatory user terms, the platform's mandatory terms prevail.

Apple and Google are not responsible for the app, its content, or any claims relating to it, and are third-party beneficiaries of these Terms only to the limited extent required by their developer programme agreements.

23. Governing law

These Terms are governed by the laws of England and Wales. Disputes arising out of or in connection with them are subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers may have a choice of jurisdiction under mandatory local consumer protection law.

24. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-app (banner or email) at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms. Historical versions are retained on request.

25. Severability and entire agreement

If any part of these Terms is held unenforceable, the remainder continues in effect. These Terms, together with the Privacy Policy and any platform-specific terms (App Store, Google Play), form the entire agreement between you and The Pontaro Company, LLC regarding ClearaScan.
